Laws on Using CCTV Footage
Guidelines for the Workplace
Many businesses use a form of closed circuit television (CCTV) for security purposes. By doing so, there are certain guidelines on how to legally record what goes on in the workplace and how to go about using the CCTV footage captured.
CCTV in the Workplace
There are a number of reasons why a company would set up a CCTV system:
- Safety. Help ensure a safe and healthy work environment, and produce footage of any specific event that disputes this claim.
- Security. Preventing theft, violence, and other crimes.
- Regulations. Provide evidence of upholding industry regulations.
- Productivity. Monitoring and assessing current workflow practices.
All of these reasons are legitimate. However, there are certain rules and regulations to follow when installing any kind of recording device in a public space. Business owners need to assess the importance of monitoring the workplace and how it impacts the day-to-day. Customer and employees still need a sense of privacy in addition to security.
Laws and Regulations on Using CCTV Footage
Before installing a CCTV system, business owners should be familiar with any federal and state laws regarding privacy. Even if it’s as simple as making people aware they’re being recorded, these rules need to be followed in order to uphold the law and save the business from future legal action.
Some laws may be more general in what can and can’t be recorded. Other laws state specifically whether audio and/or video can be used as well as a time frame in which the footage is still valid. Once you’ve researched all the facts and develop a plan for implementation, there are still ways to protect yourself, your company, employees, vendors, customers, etc.:
- Communicate the nature and reasons for monitoring, and supply the staff with written outlines.
- Discuss all of the privacy practices put in place.
- Provide a forum to voice concerns, ask questions, and challenge any footage used in disciplinary actions.
CCTV System Implementation
Once the research is complete and a plan is set, it’s time to install the right CCTV system. This step is just as important, and the security team you choose should also be aware of the current laws and regulations around workplace surveillance.
